An 11-year-old girl who threw a stone at a group of boys pelting her with water balloons is being prosecuted on serious assault charges in California.
Maribel Cuevas was arrested in April in a police operation which involved three police cars and a helicopter.
She has since spent five days in detention, in which she was granted one 30 minute visit by her parents, and has spent a month under house arrest.
Her lawyer accuses the authorities of criminalising childhood behaviour.
"They're treating her like a violent parole offender," Richard Beshwate said. "It's not a felony, it's an 11-year-old acting like an 11-year-old."
The girl is due back in court at the beginning of next month.
Police say they had to investigate as the boy who was hit by the stone she threw suffered a deep gash to his head and needed hospital treatment.
He has reportedly acknowledged to officers that he started the fight in late April.
'Obligation'
The confrontation happened in a poor district of Fresno, in central California, where Maribel Cuevas lives with her Spanish-speaking family.
The girl, who speaks little English, has admitted throwing a stone at a group of boys she says were pestering her with water balloons as she walked down the street.
An ambulance was called, but arrived flanked by three police patrol vehicles. A helicopter meanwhile hovered overhead.
The 11-year-old was then read her rights twice in English before being detained.
"We responded. We determined a felony assault had taken place and the officers took the actions that were necessary," said Fresno Police Sergeant Anthony Martinez.
Another police officer told ABC News that the girl, when asked what she thought would happen if she threw the stone, replied that it would make him "bleed".

She's a threat to national security.
The media never gives the full story in situations like this... they always write it in favor of children, basically. I don't think you can make a true judgement based on what little information they gave us.
Oh my how times have changed.
When I was in 5th grade (9 years ago I believe) I broke some kids arm in self defense. To make a long story short, he was the playground bully and had something against me. When everyone was walking in after recess, he was holding the door open, and as I walked through, tried to close it on me and knock me down. Well, I was bigger and stronger than he was, so shoved the door the opposite direction pinning him between a steel door and brick wall. Police didn't get involved, the school principal sided with me, saying I acted in self defense. And I'm glad that was all that happened. By the sound of things, if that would have happened today, I'd be doing time in jail because breaking some kids arm is definitley assault.
What they're doing to the poor girl is bullshit.

Wow that sucks. Im alright with strict policework and whatnot. But dont they realize that there is so much more stuff that needs police attention. But they decide to go after a little girl who was trying to defend herself. If it was me, I would've thrown more than just a rock.

What the fuck? How can they do that to an 11 year old? She hardly tried to kill anyone either. All she did was throw a stone, what's it gonna do? At most take your eye out. She's hardly a menace to society.
Like I said: you can't judge the situation based on the biased information that the media is obviously getting in this situation. You really need much more sources and information before you can jump to conclusions about this.

Damn, they probably did all that to her becasue she's Mexican or whatever. When I was..9 I threw a rock at a kid's head and I didn't get arrested.

There has to be something else...the police can't just arrest a girl for throwing a rock. The media is biased and there has to be something else the girl did. If not...what the police did was the nastiest shit that is theoretically able to come out of a bull.

I shouldn't be laughing at this, because of what's being done to the poor girl and all.. hopefully i'm not the only one. But i'm merely just laughing at the obsurdity of the situation.

Exactly my point. The media isn't telling the whole story here, if you ask me. Could they be? Yeah, but that's highly doubtful, given what they've stated. They're only reporting what they want to, it seems.
I highly doubt they called in a helicopter because she threw a rock... something doesn't add up.

OMG! That girl was just trying to protect herself only. I don't think she is guilty. Between it was the guy who throw a water balloon to her first. In other word, she throw the stone to defence herself. And why do they need to arrest the girl using a helicopter? She was only 11 years old, she is not a robber with guns or any explosive material. That is sound stupid using a helicopter to arrest a 11 years old girl who throw stone anyway.

And now for a different perspective:
Police Chief Jerry Dyer disagrees: "This was not a matter of just throwing rocks. … It was a boulder. If it hit right on the temple, it could have caused him to die."
Maribel knew what she did and what harm she could do, police said.
Dyer said that when officers asked Maribel what the 2-pound rock could do, she answered: "It could make him bleed."
Police also said Maribel threw herself on the ground, scratched officers and kicked rather than being cooperative with police.
According to Maribel's parents and police, Elijah and other boys had been taunting Maribel and throwing water balloons at her. Maribel responded by throwing a bat at Elijah. When the bat didn't hit the boy, Maribel picked up the rock and threw it, according to the police report. Elijah, whom police say is 6 years old but Maribel's family says is 9, was taken to the hospital, where a doctor stitched his wound.

Like I said, the media's biased... this one obviously takes the other side of the story. I haven't found a story that's in-between yet (giving both the information that this story does and the information that the one here does).

Yes, the boy admitted that, but the girl also admitted she threw a large rock at him. She also through a baseball bat at him that luckily missed. I just thought it was funny how everyone was automatically siding with the girl because how the media tried to portray the story.
95% of the time if a story sounds extremely biased, it is.
